Development Kit Buyer Terms

These terms apply when you purchase items labeled as development kits. They supplement our Terms of Service. For any conflict, these terms control.

1. Scope

These terms apply to the Kymopsis development kit NDTH7-JDM44CJ02-Y and any other item we label “development kit” (the “Kit”). They are in addition to our Terms of Service, including the section “Radio and export rules”. If they conflict for the Kit, these terms control.

2. Who may buy

You may buy a Kit only if you are (a) a product developer who evaluates the Kit’s components, circuitry, or software to decide whether to include them in a finished product, (b) a software developer writing software for use with an end product, or (c) a system integrator. You may not buy a Kit for personal, household, or consumer use, as a finished device, or on behalf of anyone who is not eligible.

3. Permitted use

Use the Kit only for evaluation and software development, in a manner consistent with laws in your location. The Kit is not a finished product and is not FCC certified, CE marked, or otherwise certified or approved as radio equipment for any market.

4. FCC notice (United States)

FCC NOTICE: This kit is designed to allow: (1) Product developers to evaluate electronic components, circuitry, or software associated with the kit to determine whether to incorporate such items in a finished product and (2) Software developers to write software applications for use with the end product. This kit is not a finished product and when assembled may not be resold or otherwise marketed unless all required FCC equipment authorizations are first obtained. Operation is subject to the condition that this product not cause harmful interference to licensed radio stations and that this product accept harmful interference. Unless the assembled kit is designed to operate under part 15, part 18 or part 95 of this chapter, the operator of the kit must operate under the authority of an FCC license holder or must secure an experimental authorization under part 5 of this chapter.

Each Kit must carry, and will be shipped with, the label: “For evaluation only; not FCC approved for resale.”

5. Limits

You will not: (a) resell, lease, or distribute the Kit as a finished product; (b) install or assemble the Kit into any product that you offer for sale, lease, or distribution unless all required equipment authorizations and other legal approvals for that product are first obtained; (c) operate the Kit outside the conditions of the notice or where its operation requires a license, authorization, or approval you do not hold; (d) remove or obscure the label or notice; (e) use the Kit in aircraft, in vehicles on public roads, or for safety-critical, medical, or life-support purposes.

6. Your responsibility for radio rules

Radio-frequency rules differ by country. We do not state that the Kit meets any country’s technical or authorization requirements, and we have no test report to share. You are responsible for determining whether you may import, possess, and operate the Kit where you are, for obtaining any license or experimental authorization needed, and for stopping operation if it causes or may cause harmful interference.

7. Export and import compliance

You confirm that (a) you are not subject to sanctions or on a restricted-party list, (b) the Kit will not be used for any military, weapons, surveillance-of-persons, or other prohibited end use, and (c) you will not export, re-export, or transfer the Kit in violation of applicable law. We pay import duties and import VAT on catalog orders (see the Shipping Policy). You remain responsible for any local import approval, licence, or authorization needed to import or operate the Kit. We may delay, refuse, or cancel an order where law requires or where we cannot confirm compliance.

8. Accuracy and records

The confirmation you give at checkout is a statement that we rely on. If it is untrue or later changes (for example you intend to resell), do not use the Kit and contact us. We record your confirmation, the terms version, and the order, for the period needed for legal and accounting purposes, as described in our Privacy Policy.

9. Our rights

We may cancel an order and refund the price paid if we reasonably believe you are not an eligible buyer or that sale would break the law, and we may request more information about your intended use.

10. Responsibility

To the extent the law allows, we are not responsible for loss caused by use of the Kit outside these terms, by your failure to obtain authorizations, or by your resale or incorporation into a product. Nothing here limits any right you cannot lawfully waive.
